House Bill 242 Goes to Governor’s Desk

Yesterday, House Bill 242 (Representative Everett, R-Lycoming) was passed in both the Senate and House and is expected to be signed by the Governor.  This bill contains many items that may help licensees.
  • HB 242 will allow hotels, restaurants and country clubs to serve alcohol on Sunday at 9am, if serving with a meal.  (This will be effective immediately).
     
  • Noise levels would be mandated to be measured from beyond the property line of the licensed establishment.  (This will be effective immediately).
     
  • A noise ordinance would no longer be the sole reason for license non-renewal unless the venue receives six adjudicated noise violations in a 24 month period. (This will be effective immediately.)
     
  • Licensees would be able to keep records off-premise, except for the current six-month period. (Effective in 60 days.)
     
  • Require Responsible Alcohol Management (RAMP) training for managers.  (Effective in 60 days.)
     
  • A bad check would not be a violation unless it is not rectified after a 10 day period.  (Effective in 60 days.)
